NextAIForge, LLC, a Delaware limited liability company ("NextAIForge," "we," "us," or "our"), provides AI visibility and Answer Engine Optimization services and operates nextaiforge.com. This Privacy Policy explains how we collect, use, disclose, and protect personal information.

Our registered office in Delaware is 131 Continental Dr, Suite 305, Newark, Delaware 19713, New Castle County. Our registered agent at that address is Legalinc Corporate Services Inc.

This Policy is written for U.S. business-to-business services. If we materially change our data practices, we will update this Policy and the "Last updated" date. Where required by law, we will provide additional notice or obtain consent.

1. Personal information we collect

We collect the following categories of personal information, depending on how you interact with us:

  • Contact information: name, business email, business phone, company, title,

mailing address, and message content.

  • Account and client information: billing contact, plan, engagement records,

approvals, support requests, and business communications.

  • Payment information: payment status, invoices, and transaction metadata.

Payment card details are processed by Stripe and are not stored by us.

  • Website and device information: IP address, browser type, device

identifiers, pages viewed, referring pages, timestamps, approximate location, and similar analytics or security logs.

  • Client-provided materials: public URLs, brand materials, content drafts,

approved prompts, public business information, and other materials supplied or approved by a client.

  • Measurement data: answers, citations, model outputs, search or AI response

snapshots, scoring data, and related evidence about companies, brands, and public business information.

Our Services are intended to measure companies, not private individuals. We do not intentionally profile a natural person as the measurement subject unless the scope, lawful basis, retention period, and required assessment are documented in writing first.

2. Sensitive information and children's data

Do not submit sensitive personal information unless we specifically request it in a signed agreement. Sensitive information includes government identifiers, financial account numbers, precise geolocation, health information, biometric data, genetic data, children's data, race or ethnicity, religious beliefs, sexual orientation, immigration status, and similar regulated data.

Our website and Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.

3. Sources of personal information

We collect personal information directly from you, from your company, from payment and infrastructure providers, from public websites and public business sources, from analytics and security tools, and from third-party AI or search systems when generating measurement evidence.

4. How we use personal information

We use personal information to:

  • provide, measure, secure, support, and improve the Services;
  • respond to inquiries and manage customer relationships;
  • create reports, deliverables, invoices, and operational records;
  • process payments and prevent fraud;
  • maintain security, debug issues, and monitor service performance;
  • send service, transactional, administrative, and legally required notices;
  • send marketing communications where permitted, with opt-out rights;
  • enforce agreements and protect our rights, users, clients, and services;
  • comply with law, legal process, and regulatory obligations.

5. How we disclose personal information

We disclose personal information to:

  • Service providers and processors that host, secure, analyze, email,

process payments, provide customer support, or otherwise help operate the Services, including Stripe, Vercel, Cloudflare, Resend, and Migadu.

  • AI, search, and measurement providers such as OpenAI, Perplexity, Google

Gemini, and Anthropic when needed to run agreed public measurement queries. We do not intentionally send private Client personal information in measurement prompts.

  • Professional advisers such as lawyers, accountants, auditors, insurers,

and security consultants.

  • Authorities or litigants when required by law, subpoena, court order, or to

protect rights, safety, and security.

  • Business transaction parties in connection with a merger, acquisition,

financing, reorganization, bankruptcy, or sale of assets.

  • Clients or users at their direction or with their consent.

We do not sell personal information for money. We do not knowingly sell or share personal information of individuals under 16. If we use advertising or analytics tools that are considered a "sale," "sharing," or targeted advertising under an applicable state privacy law, we will provide the required opt-out mechanism.

6. Cookies, analytics, and tracking choices

We may use cookies, pixels, local storage, logs, and similar technologies for site functionality, analytics, security, fraud prevention, and performance. If we use cross-context behavioral advertising or targeted advertising, we will provide the disclosures and opt-out choices required by applicable law.

Some browsers send "Do Not Track" signals. There is no uniform industry standard for responding to those signals. Where legally required, we will honor recognized opt-out preference signals such as Global Privacy Control for covered processing.

7. Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including to provide Services, maintain business records, comply with law, resolve disputes, enforce agreements, preserve security, and keep suppression records for marketing opt-outs.

Typical retention targets are:

  • prospect and inquiry records: up to 24 months after last meaningful contact;
  • client records: for the contract term plus up to 7 years for tax, accounting,

legal, and audit needs;

  • security logs: typically 30 to 365 days unless needed longer for security or

legal reasons;

  • measurement evidence: for the applicable contract term plus up to 24 months,

unless a longer period is needed for audit trails, dispute resolution, legal compliance, security, or de-identified benchmarking.

8. Security

We use commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information, such as encryption in transit, access controls, least-privilege credentials, audit logging, and vendor controls. No system or transmission method is perfectly secure.

9. U.S. state privacy rights

Depending on where you live and whether a state privacy law applies to us, you may have rights to access, correct, delete, obtain a copy of, or opt out of certain processing of your personal information, including sale, sharing, targeted advertising, or certain profiling. You may also have the right to appeal a denied request and to be free from unlawful discrimination for exercising your rights.

To exercise privacy rights, contact privacy@nextaiforge.com. We may need to verify your identity and authority before fulfilling a request. Authorized agents may submit requests where permitted by law.

10. California notice

If the California Consumer Privacy Act, as amended, applies to us, this section serves as our California notice at collection and privacy notice. In the past 12 months, we may have collected the categories listed in Section 1, used them for the purposes in Section 4, and disclosed them to the categories of recipients in Section 5.

We do not use or disclose sensitive personal information for purposes that would require a California right to limit unless we provide the required notice and choice. We do not knowingly sell or share personal information of consumers under 16. We will not discriminate against you for exercising CCPA rights.

If we engage in a sale or sharing of personal information under California law, we will provide a clear "Do Not Sell or Share My Personal Information" link or a legally recognized alternative.

11. International users

We are based in the United States, and personal information may be processed in the United States and other countries where our service providers operate. If European, UK, or Swiss data protection laws apply, additional terms such as our Data Processing Addendum may apply to client-controlled personal data.

12. Marketing email

Commercial emails from us will identify the sender, avoid deceptive subject lines, include our mailing address where required, and provide an unsubscribe mechanism. We will honor marketing opt-out requests as required by law. Service, transactional, billing, security, and legal notices may still be sent where permitted.
